As promised, I’ve reviewed advisory opinions and changes made to the Education Law in 2010 regarding
access to performance reviews, and note the following:

Recent amendments to Education Law pertain to performance reviews of teachers and principals
only. Accordingly, our advice regarding access to evaluations of Asst Superintendents remains in
accordance with the following advisory opinion: http://docs.dos.ny.gov/coog/ftext/f12396.htm

Recent amendments to the Education Law require disclosure of “final quality ratings and composite
effectiveness scores from the annual professional performance reviews of its teachers and
principals…”. See section 3012-a(10). Subparagraph (a) requires the Commissioner of Education to
disclose professional performance review data for teachers and principals in each school district, and
paragraph (b) requires disclosure of final quality rating and composite effectiveness scores of teachers
and principals to parents and legal guardians of students who currently take classes from such teachers
under the supervision of such principles. These requirements became effective July 1, 2010.
